Rights\uff0c\u7c21\u7a31IPR\uff09\uff0c\u4fc2\u6307\u4eba\u985e\u7cbe\u795e\u6d3b\u52d5\u4e4b\u6210\u679c\u800c\u80fd\u7531\u300c\u7121\u5f62\u7684\u8ca1\u7522\u300d\u7522\u751f\u50f9\u503c\u8005\uff0c\u5f97\u7531\u6cd5\u5f8b\u4fdd\u969c\u5176\u6b0a\u5229\u3002\u5be6\u8cea\u4e0a\u4ee5\u300c\u58df\u65b7\u6b0a\u300d\u5b9a\u7fa9\u667a\u6167\u7522\u6b0a\u66f4\u78ba\u5207\u3002\u901a\u904e\u9019\u7a2e\u58df\u65b7\u6b0a\u5229\u6388\u4e88\uff0c\u5275\u9020\u8005\u80fd\u5920\u85c9\u5c0d\u4f7f\u7528\u5176\u5c08\u5229\u8005\u6536\u53d6\u8cbb\u7528\uff0c\u6216\u5728\u7279\u8a31\u7684\u6642\u9650\u5167\u7981\u6b62\u4ed6\u4eba\u4eff\u5192\u6284\u8972\uff0c\u7368\u4f54\u5e02\u5834\u800c\u7372\u5f97\u5229\u76ca\u5831\u511f\u3002\u4fb5\u5bb3\u4ed6\u4eba\u667a\u6167\u8ca1\u7522\u6b0a\u7684\u9055\u6cd5\u884c\u70ba\uff0c\u8207\u4fb5\u5bb3\u4ed6\u4eba\u6709\u5f62\u8ca1\u7522\u4e4b\u7d50\u679c\u662f\u76f8\u540c\u7684\uff0c\u7a76\u5176\u6cd5\u5f8b\u8cac\u4efb\uff0c\u9664\u4e86\u9808\u5c0d\u6b0a\u5229\u6301\u6709\u4eba\u8ca0\u6c11\u4e8b\u7684\u640d\u5bb3\u8ce0\u511f\u8cac\u4efb\u5916\uff0c\u4e5f\u53ef\u80fd\u8981\u53d7\u5230\u5211\u4e8b\u4e0a\u7684\u8655\u7f70\u3002<\/p>\r\n<p>1967\u5e74\u570b\u969b\u9593\u6240\u5efa\u7acb\u7684\u300c\u4e16\u754c\u667a\u6167\u8ca1\u7522\u6b0a\u7d44\u7e54\u516c\u7d04\u300d\uff08Convention Establishing the World Intellectual Property organization\uff09\u5373\u4ee5\u55ae\u4e00\u4e4b\u516c\u7d04\uff0c\u7d71\u4e00\u898f\u7bc4\u76f8\u95dc\u667a\u6167\u8ca1\u7522\u6b0a\u4e4b\u5b9a\u7fa9\u53ca\u4fdd\u8b77\u3002\u4f46\u6587\u5316\u53ca\u79d1\u6280\u65e5\u65b0\u6708\u7570\uff0c\u539f\u59cb\u5b9a\u7fa9\u904e\u65bc\u62bd\u8c61\u3002\u9700\u8981\u66f4\u7cbe\u78ba\u7684\u898f\u7bc4\uff0c\u56e0\u800c\u57281933\u5e74\u5b8c\u6210\u70cf\u62c9\u572d\u300c\u95dc\u7a05\u66a8\u8cbf\u6613\u5354\u5b9a\u300d\uff08General Agree of Tariffs and Trade\uff0cGATT\uff09\u56de\u5408\u8ac7\u5224\uff0c\u4e26\u65bc1994\u5e74\u7c3d\u7f72\u4e86\u5305\u62ec\u300c\u8207\u8cbf\u6613\u6709\u95dc\u4e4b\u667a\u6167\u8ca1\u7522\u6b0a\u5354\u5b9a\u300d\uff08\u7c21\u7a31 TRIPS\uff09\u5354\u5b9a\u3002\u4f9d\u64da\u8a72\u5354\u5b9a\uff0c\u88ab\u5217\u5165\u70ba\u667a\u6167\u8ca1\u7522\u6b0a\u7684\u9805\u76ee\u70ba\uff1a<\/p>\r\n<p>1\u3001\u8457\u4f5c\u6b0a\u53ca\u76f8\u95dc\u6b0a\u5229<\/p>\r\n<p>2\u3001\u5546\u6a19<\/p>\r\n<p>3\u3001\u7522\u5730\u6a19\u793a<\/p>\r\n<p>4\u3001\u5de5\u696d\u8a2d\u8a08<\/p>\r\n<p>5\u3001\u5c08\u5229<\/p>\r\n<p>6\u3001\u7a4d\u9ad4\u96fb\u8def\u4e4b\u96fb\u8def\u5e03\u5c40<\/p>\r\n<p>7\u3001\u672a\u7d93\u516c\u958b\u8cc7\u8a0a\u4e4b\u4fdd\u8b77<\/p>\r\n<p>8\u3001\u5951\u7d04\u6388\u6b0a\u6642\u6709\u95dc\u53cd\u7af6\u722d\u884c\u70ba\u4e4b\u63a7\u5236\u3002<\/p>\r\n<p>\u570b\u969b\u9593\u5408\u4f5c\u4fdd\u969c\u667a\u6167\u7522\u6b0a\u5c08\u5229\u7684PCT\uff08 Patent Cooperation Treaty \uff09\u689d\u7d04\uff0c\u65bc 1970 \u5e74\u7c3d\u7f72\u4e26\u65bc1978 \u5e74\u751f\u6548\uff0c\u7531\u4e16\u754c\u667a\u6167\u8ca1\u7522\u6b0a\u7d44\u7e54\uff08World Intellectual Property Organization\uff0c\u7c21\u7a31WIPO\uff09\u4e2d\u7684\u570b\u969b\u5c40\u7ba1\u7406\uff0c\u4e43\u4e00\u500b\u65b9\u4fbf\u7533\u8acb\u4eba\u7372\u5f97\u773e\u591a\u5916\u570b\u5c08\u5229\u4fdd\u8b77\u7684\u570b\u969b\u6027\u689d\u7d04\u3002\u76ee\u524d\u6703\u54e1\u570b\u6709145\u570b\uff0c\u5982\u7f8e\u570b\u3001\u65e5\u672c\u3001\u52a0\u62ff\u5927\u3001\u4e2d\u570b\u3001\u97d3\u570b\u3001\u5fb7\u570b\u3001\u6cd5\u570b\u3001\u82f1\u570b\u53ca\u773e\u591a\u958b\u767c\u4e2d\u7684\u570b\u5bb6\u7b49\uff0c\u5e7e\u4e4e\u542b\u84cb\u4e86\u5168\u4e16\u754c\u6240\u6709\u5be6\u65bd\u5c08\u5229\u5236\u5ea6\u7684\u570b\u5bb6\u3002\u9019\u662f\u4e00\u7a2e\u7a97\u53e3\u5236\u7684\u300c\u570b\u969b\u5c08\u5229\u7533\u8acb\u300d\uff0c\u800c\u975e\u8a31\u53ef\u5236\u7684\u300c\u570b\u969b\u5c08\u5229\u6388\u6b0a\u300d\u3002\u4e2d\u570b\u5927\u9678\u570b\u5bb6\u77e5\u8b58\u7522\u6b0a\u5c40\u65bc1994\u5e74\u52a0\u5165PCT\uff0c\u76ee\u524d\u53f0\u7063\u5247\u5c1a\u672a\u52a0\u5165\u3002\u53f0\u7063\u7684\u767c\u660e\u4eba\u82e5\u8981\u85c9\u7531PCT\u7684\u5c08\u5229\u7533\u8acb\u5236\u5ea6\uff0c\u9032\u800c\u53d6\u5f97\u591a\u570b\u7684\u570b\u5916\u5c08\u5229\u4fdd\u8b77\u6642\uff0c\u53ef\u900f\u904e\u5148\u884c\u9001\u4ef6\u7533\u8acb\u4e2d\u570b\u5927\u9678\u5c08\u5229\uff0c\u518d\u4ee5\u4e2d\u570b\u5927\u9678\u7684\u5c08\u5229\u7533\u8acb\u65e5\u4f5c\u70baPCT\u7684\u512a\u5148\u6b0a\u8d77\u59cb\u65e5\u8b8a\u901a\u3002<\/p>\r\n<p>\u7f8e\u570b\u662f\u59cb\u5021\u667a\u6167\u8ca1\u7522\u6b0a\u7684\u5143\u8001\uff0c\u5c0d\u65bc\u667a\u6167\u7522\u6b0a\u7684\u4fdd\u8b77\uff0c\u6709\u975e\u5e38\u56b4\u683c\u7684\u6cd5\u898f\u9650\u5236\u8207\u8981\u6c42\u3002\u5728\u570b\u969b\u8cbf\u6613\u65b9\u9762\uff0c\u901a\u904e\u5176\u7d9c\u5408\u8cbf\u6613\u6cd5\u6848\u7684\u300c\u7279\u6b8a301\u689d\u6b3e\u300d\uff0c\u5c0d\u7af6\u722d\u5c0d\u624b\u4e88\u4ee5\u6253\u58d3\uff0c\u53c8\u7a4d\u6975\u63a8\u52d5\u4e16\u754c\u8cbf\u6613\u7d44\u7e54\u7684\u667a\u6167\u8ca1\u7522\u6b0a\u5354\u8b70\uff0c\u5f9e\u800c\u5f62\u6210\u4e86\u4e00\u5957\u6709\u5229\u65bc\u7f8e\u570b\u7684\u65b0\u7684\u570b\u969b\u8cbf\u6613\u898f\u5247\u3002\u5546\u8005\u5c0d\u9019\u65b9\u9762\u7684\u6cd5\u5f8b\u898f\u5b9a\u61c9\u500d\u52a0\u6ce8\u610f\uff0c\u4e00\u65b9\u9762\u907f\u514d\u5728\u7121\u610f\u4e2d\u4fb5\u72af\u4ed6\u4eba\u7684\u667a\u6167\u7522\u6b0a\uff0c\u540c\u6642\u4e5f\u61c9\u59a5\u70ba\u4fdd\u8b77\u81ea\u5df1\u7684\u5fc3\u529b\u7d50\u6676\u3002<\/p>\r\n<p>\u5982\u6709\u4efb\u4f55\u5207\u8eab\u6cd5\u5f8b\u7591\u96e3\uff0c\u8acb\u6d3d\u8a62\u5289\u7f8e\u82b3\u5f8b\u5e2b\u4e8b\u52d9\u6240\u3002
