rel=\"noopener\">\u6c11\u4e8b\u8a34\u8a1f<\/a>\u662f\u4ec0\u9ebc\uff1f\u7576\u500b\u4eba\u6216\u96c6\u9ad4\u4e4b\u9593\uff0c\u5728\u751f\u6d3b\u3001\u91d1\u9322\u3001\u4eba\u8207\u4eba\u4e4b\u9593\u7684\u95dc\u4fc2\u4e0a\u6709\u722d\u8b70\u6216\u7cfe\u7d1b\uff0c\u5373\u6709\u6b0a\u5411\u6cd5\u9662\u63d0\u51fa\u6c11\u4e8b\u8a34\u8a1f\uff0c\u608d\u885b\u81ea\u8eab\u6cd5\u5f8b\u6b0a\u76ca\u3002\u6c11\u4e8b\u8a34\u8a1f\u7bc4\u4f8b\u53ef\u4ee5\u56ca\u62ec\u5546\u696d\u7cfe\u7d1b\u3001\u96e2\u5a5a\u722d\u7522\u3001\u6c11\u4e8b\u50b5\u52d9\u8ffd\u511f\u3001\u6c11\u4e8b\u50b7\u5bb3\u8ce0\u511f\u3001\u623f\u5730\u7522\u8cb7\u8ce3\uff0c\u958b\u767c\u7cfe\u7d1b\uff0c\u540d\u8b7d\u6bc1\u8b17\u6c42\u511f\uff0c\u7b49\u7b49\u5728\u751f\u6d3b\u4e2d\u96a8\u6642\u53ef\u80fd\u767c\u751f\u7684\u5927\u5927\u5c0f\u5c0f\u4e8b\u4ef6\u3002<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E7%BE%8E%E5%9C%8B%E5%8A%A0%E5%B7%9E%E6%B0%91%E4%BA%8B%E8%A8%B4%E8%A8%9F%E6%B5%81%E7%A8%8B\"><\/span>\u7f8e\u570b\u52a0\u5dde\u6c11\u4e8b\u8a34\u8a1f\u6d41\u7a0b<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u7576\u88ab\u544a\u63a5\u5230\u6c11\u4e8b<a href=\"https:\/\/www.castletonlaw.com\/blog\/tag\/%e8%a8%b4%e7%8b%80\/\" target=\"_blank\" rel=\"noopener\">\u8a34\u72c0<\/a>\u6642\uff0c\u61c9\u5148\u4e86\u89e3\u539f\u544a\u7684\u8a34\u6c42\uff0c\u518d\u4f86\u64ec\u5b9a\u521d\u671f\u7684\u8a34\u8a1f\u7b56\u7565\uff0c\u4f8b\u5982\u539f\u544a\u7684\u8acb\u6c42\u662f\u5426\u904e\u4e86\u6c11\u4e8b\u8a34\u8a1f\u6642\u6548\uff0c\u662f\u5426\u6e05\u695a\u9673\u8ff0\u4e8b\u5be6\uff0c\u662f\u5426\u544a\u932f\u4e86\u4eba\u3001\u9001\u932f\u4e86\u6cd5\u9662\uff0c\u7b49\u7b49\u3002\u4e00\u822c\u5e38\u898b\u7684\u6c11\u4e8b\u8a34\u8a1f\u6d41\u7a0b\uff0c\u5927\u591a\u5f9e\u539f\u544a\u905e\u4ea4\u6cd5\u9662\u7684\u8a34\u72c0\u958b\u59cb\uff0c\u7d93\u904e\u88ab\u544a\u905e\u4ea4\u7b54\u8faf\u72c0\u3001\u96d9\u65b9\u641c\u96c6\u76f8\u95dc\u7684\u4eba\u8b49\u7269\u8b49\u3001\u6848\u4ef6\u5be9\u7406\u3001\u800c\u4ee5\u6700\u7d42\u5be9\u5224\u70ba\u7d42\u3002<\/p>\n<p>\u6709\u4e9b\u60c5\u6cc1\u4e0b\uff0c\u88ab\u544a\u5148\u5225\u6025\u8457\u905e\u4ea4\u6c11\u4e8b\u7b54\u8faf\u72c0\u4f86\u53cd\u99c1\u8a34\u72c0\uff0c\u800c\u61c9\u8a72\u8003\u616e\u5229\u7528\u52a0\u5dde\u6c11\u4e8b\u8a34\u8a1f\u4e2d\u7684<a href=\"https:\/\/www.castletonlaw.com\/blog\/tag\/%e5%a6%a8%e8%a8%b4%e6%8a%97%e8%be%af\/\" target=\"_blank\" rel=\"noopener\">\u59a8\u8a34\u6297\u8faf<\/a>\uff08Demurrer)\uff0c\u9019\u8aaa\u4e0d\u5b9a\u53ef\u4ee5\u907f\u514d\u88ab\u62d6\u9032\u5197\u9577\u7684\u6c11\u4e8b\u8a34\u8a1f\u6d41\u7a0b\u7576\u4e2d\u3002<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E4%BD%95%E8%AC%82%E6%B0%91%E4%BA%8B%E8%A8%B4%E8%A8%9F%E5%A6%A8%E8%A8%B4%E6%8A%97%E8%BE%AF\"><\/span>\u4f55\u8b02\u6c11\u4e8b\u8a34\u8a1f\u59a8\u8a34\u6297\u8faf<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u52a0\u5dde\u6c11\u4e8b\u8a34\u8a1f\u4e2d\uff0c\u59a8\u8a34\u6297\u8faf\u4e00\u822c\u610f\u6307\u88ab\u544a\u8a8d\u70ba\u8a34\u72c0\u6b20\u7f3a\u67d0\u4e9b\u8981\u4ef6\uff0c\u6cd5\u5f8b\u4e0a\u4e0d\u8db3\u4ee5\u652f\u6301\u5176\u8acb\u6c42\uff0c\u56e0\u6b64\u88ab\u544a\u5728\u6cd5\u5f8b\u4e0a\u7121\u7fa9\u52d9\u7e7c\u7e8c\u63a8\u9032\u8a34\u8a1f\u7684\u4e00\u7a2e\u6297\u8faf\u7533\u8acb\u3002<\/p>\n<p>\u4e0d\u540c\u65bc\u7b54\u8faf\u72c0\uff08Answer\uff09\uff0c\u59a8\u8a34\u6297\u8faf\u662f\u4e00\u7a2e\u7279\u6b8a\u7684\u56de\u61c9\u65b9\u5f0f\u3002\u5b83\u6307\u51fa\u8a34\u72c0\u7684\u6f0f\u6d1e\u3001\u4e0d\u5145\u5206\u4e4b\u8655\uff0c\u6240\u9673\u8ff0\u7684\u4e8b\u9805\u4e0d\u8db3\u4ee5\u69cb\u6210\u8a34\u56e0\u7b49\u7b49\uff0c\u4e26\u4ee5\u6b64\u4f86\u53cd\u99c1\u539f\u544a\u905e\u4ea4\u6cd5\u9662\u7684\u8a34\u72c0\u3002\u82e5\u7372\u5f97\u6cd5\u9662\u7684\u652f\u6301\uff0c\u90a3\u9ebc\u6cd5\u9662\u53ef\u4ee5\u5c0d\u8a34\u72c0\u4e2d\u7684\u67d0\u500b\u8acb\u6c42\uff0c\u751a\u81f3\u662f\u6574\u500b\u8a34\u72c0\u4e88\u4ee5\u99c1\u56de\uff0c\u6216\u547d\u5176\u4fee\u6b63\u3002<\/p>\n<p><img class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u53ea\u8981\u6536\u5230\u6c11\u4e8b\u8a34\u8a1f\u50b3\u7968\u53ca\u8a34\u72c0\uff0c\u50b3\u7968\u4e0a\u901a\u5e38\u6703\u8a3b\u660e\u63d0\u51fa\u56de\u61c9\u7684\u6642\u9650\uff0c\u8996\u6848\u4ef6\u985e\u578b\u800c\u5b9a\uff0c\u4e00\u822c\u70ba30\u5929\u3002\u6642\u9593\u7dca\u8feb\uff0c\u6b64\u6642\u61c9\u628a\u63e1\u826f\u6a5f\uff0c\u614e\u91cd\u7684\u8207\u4e00\u4f4d\u5c08\u696d\u7684\u52a0\u5dde\u6c11\u4e8b\u8a34\u8a1f\u5f8b\u5e2b\u5546\u8ac7\u5c0d\u7b56\u3002\u82e5\u662f\u8a34\u72c0\u53ef\u4ee5\u5728\u7b2c\u4e00\u6642\u9593\u4fbf\u8b93\u6cd5\u9662\u4e0b\u4ee4\u99c1\u56de\uff0c\u907f\u514d\u5f8c\u671f\u884d\u751f\u7684\u8a34\u8a1f\u8cbb\u7528\u53ca\u8a34\u8a1f\u98a8\u96aa\uff0c\u90a3\u662f\u8a31\u591a\u88ab\u544a\u6c42\u4e4b\u4e0d\u5f97\u7684\u4e8b\u3002<\/p>\n<p>\u7576\u60a8\u7684\u6c11\u4e8b\u5f8b\u5e2b\u63d0\u4ea4\u59a8\u8a34\u6297\u8faf\u7684\u7533\u8acb\uff0c\u6cd5\u9662\u5373\u6703\u5b89\u6392\u51fa\u5ead\u65e5\u671f\u3002\u4e00\u65e6\u6cd5\u9662\u5224\u6c7a\u51fa\u7210\uff0c\u8996\u6cd5\u9662\u7684\u5224\u6c7a\u800c\u8ad6\uff0c\u6cd5\u9662\u53ef\u4ee5\u652f\u6301\u90e8\u5206\u59a8\u8a34\u6297\u8faf\u4e2d\u7684\u7533\u8acb\uff0c\u800c\u547d\u4ee4\u539f\u544a\u4fee\u6b63\u8a34\u72c0\u4e0d\u8db3\u7684\u90e8\u5206\u3002\u5047\u82e5\u59a8\u8a34\u6297\u8faf\u88ab\u6cd5\u9662\u99c1\u56de\uff0c\u6cd5\u5b98\u6703\u53e6\u884c\u7d66\u4e88\u88ab\u544a\u65b0\u7684\u671f\u9650\u4f86\u56de\u61c9\u8a34\u72c0\u3002\u7576\u7136\uff0c\u5982\u679c\u6cd5\u9662\u5b8c\u5168\u652f\u6301\u88ab\u544a\u7684\u59a8\u8a34\u6297\u8faf\uff0c\u99c1\u56de\u6574\u500b\u539f\u544a\u7684\u8a34\u72c0\uff0c\u4e0d\u7d66\u539f\u544a\u4fee\u6b63\u5176\u8a34\u72c0\u7684\u6a5f\u6703\uff0c\u90a3\u9ebc\u88ab\u544a\u5373\u53ef\u4e0d\u9808\u61c9\u8a34\uff0c\u800c\u9019\u500b\u8a34\u8a1f\u6848\u4ef6\u4e5f\u5c31\u5230\u6b64\u544a\u4e00\u6bb5\u843d\u4e86\u3002<\/p>\n<h2><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u7bc7\u5e45\u6709\u9650\uff0c\u4ee5\u4e0a\u662f\u52a0\u5dde\u6c11\u4e8b\u8a34\u8a1f\u59a8\u8a34\u6297\u8faf\u7684\u7c21\u55ae\u8aaa\u660e\u3002\u904b\u7528\u6b63\u78ba\u7684\u8a34\u8a1f\u7b56\u7565\uff0c\u5728\u4efb\u4f55\u4e00\u5834\u6c11\u4e8b\u8a34\u8a1f\u5b98\u53f8\u7576\u4e2d\u8209\u8db3\u8f15\u91cd\u3002\u8a34\u8a1f\u7b56\u7565\u4f7f\u7528\u5f97\u5b9c\uff0c\u5f80\u5f80\u80fd\u5f9e\u88ab\u544a\u7684\u88ab\u52d5\u7acb\u5834\uff0c\u8f49\u8eab\u70ba\u638c\u63a7\u8a34\u8a1f\u4e3b\u5c0e\u6b0a\u7684\u4e3b\u52d5\u7acb\u5834\uff0c\u51fa\u5947\u5236\u52dd\u3002<\/p>\n<div
